L'Ente comunale non può negare il rilascio di una Dia solo per l'assenza della planimentria o della sua sottoscrizione nella richiesta, invece ne può chiedere l'integrazione. L'atto impugnato, infatti, è stato emesso per effetto dell'omessa sottoscrizione della planimetria: una "assenza" che doveva essere derubricata a mera irregolarità documentale suscettibile di integrazione dopo l'accertamento della conformità dello stato dei luoghi, ma che non poteva considerarsi, di per sé sola, quale causa di diniego.
